  •  "Here is My Situation ..." by John Logsdon

This module will focus primarily on the legal aspects of surveying. Legal principles do not exist in a vacuum; each situation is dependent upon the specific facts. The surveyor’s initial job is to discover the facts required to complete the particular survey, including researching deeds, searching for physical evidence, and perhaps gathering parole evidence. The surveyor is then required to apply sound legal principles to the facts discovered. This module will allow open discussion of fact-specific situations involving ethics, standards of practice, boundary law, easements, Board rules, contractual issues, and other legal topics. We need your input! Please send us your fact-specific real-world situation no later than September 13th. The issue can involve boundary law, easements, Board rules, contract issues or any other legal topics.  Please include as much detail as is necessary to understand the issue and come to a possible resolution.  Click Here to Email Situations

Instructor:
John Logsdon, ESQ, PLS earned his Bachelor of Science in Civil Engineering from Duke University in 1974. He started working in the surveying field in 1983 and received his licensure in January 1987.  He owned and operated a small surveying firm in Wilkes County, NC, until 1991, when he entered law school. By day, Logsdon worked as a real estate paralegal in Durham while attending the evening program at North Carolina Central School of Law. He graduated Magna Cum Laude with a Juris Doctor degree in 1995. After obtaining his law license, Logsdon returned to Wilkes County and joined the McElwee Firm, PLLC. His practice emphasizes residential and commercial real estate transactions and the resolution of factual property disputes. He has substantial litigation experience at both the trial level and in our appellate courts. He represents individuals, developers, and corporate clients in matters of land acquisition, development, and financing, as well as commercial and business matters. He was appointed to the North Carolina Board of Examiners for Engineers and Surveyors (NCBEES) in 2016.
